Ok, so a few posts back I posted a link/story about the daughter of a friend at work. She had to have brain surgery, she doesn't have health insurance, and she is still in ICU. Well, Vicky, the mom, just got a text from someone, her son or someone, saying Fedex (the daughters employer) said if she can't return to work by the 29th of this month she will lose her job! Hello she is in the freaking hospital in the freaking ICU!! Isn't that illegal? I mean it's discrimination almost. What do they want her to do? It's just crap!!
I feel terrible for Vicky and what her family is going through with this. It is unimaginable. Her daughter has had other procedures since the initial surgery and she isn't doing well from what I hear. It just kills me.
I am really just dumbfounded right now. My jaw is still on the floor.

That totally sucks, but no, it is not illegal. They do have to give her 12 weeks for FMLA, but they do not have to give her more than that, and they dont have to guarantee her job. Sad really. I feel bad for them.
She hasn't even been out 8 weeks yet as far as I know and they do have to give her her position back. I found this information at fmlaonline.com
When they return from leave, FMLA guidelines require that companies return employees to their former position, assuming they are able to perform the essential functions of that position. If the employee is no longer able to perform his or her previous job, an alternative position with the same benefits, salary, and work hours must be provided to the disabled employee.
The only reason I can think of as to why they would let her go is she didn't qualify for FMLA.
